This is the Privacy Policy (“Policy”) for Major League Soccer, L.L.C., and its affiliates, including but not limited to: MLS NEXT, MLS NEXT Pro, MLS Go, MLS Member Clubs, and Soccer United Marketing, LLC (collectively “MLS”). This Policy explains how MLS collects, uses, discloses, protects, and stores (“Processes”) your personal data (defined below) when you visit MLS Websites and Platforms, use an MLS App, purchase tickets or attend an MLS match or event, make an MLS Store purchase, or participate as a Player. This Policy also provides personal data about the rights and choices you have regarding MLS’ collection and Processing of your personal data. This Policy should be read in conjunction with the MLS Terms of Service.

1. What personal data do we collect?
The types of personal data we collect depends on the services you use and how you interact with our Services (see **“2. How we collect your personal data”**).

3. How we use your personal data
How we use your personal data depends on how you interact with us. Please refer to the appropriate interaction type to see how we may use your personal data.
Additionally, no matter how you interact with us, we may use your personal data for the following purposes:
- To detect and prevent fraud and illegal activities;
- To perform analytics to better understand our fan base or present you with a better product;
- To comply with our legal obligations and for enforcement, including to enforce our MLS Terms of Service or investigate and prevent activities that may violate our policies or be illegal, and to respond to legal proceedings and obligations.
4. How, when, and with whom we may share or sell your personal data
How, when, and whom we share your personal data depends on how you interact with us. Please refer to the appropriate interaction type to see how we may share your personal data.
In the last twelve months, MLS has shared and sold some personal data. In some instances, you may be able to opt-out of the selling or sharing of your personal data. If you would like to exercise your right to opt-out of the sale or sharing of your data, please do so here.
We do not sell, and to our actual knowledge, we have never sold Children’s (under the age of 13) or Minor’s (between the ages of 14 – 17) personal data.
5. International Data Transfers
When we transfer your personal data to third parties as described in this Privacy Policy, some of these parties may be located in countries other than your own, such as the United States, whose privacy and data protection laws may not be equivalent to those in your country of residence. When we transfer your personal data to other countries, we apply appropriate safeguards to protect your information in accordance with applicable laws. For example, we may implement measures such as standard data protection contractual clauses to ensure that any transferred personal data remains protected and secure.
6. Your rights regarding your personal data
Individuals whose personal data we collect have certain rights regarding their personal data depending on the jurisdiction in which they reside. If you have not consented to us using your personal data as described in this Privacy Policy, we will only use it to complete the transaction or provide the service or product you have requested. - The right to limit our Use and Disclosure of your Sensitive personal data (“opt-out”) for a particular purpose
You may request that we limit the use and disclosure of your sensitive personal data in our records to that which is necessary for us to perform the services or provide the goods that you request.
- The right to opt out of the sale or sharing of your personal data.
You may request that we not share (as defined under the CCPA) or sell your personal data in our records.
- The right to lodge a complaint with Your Local Supervisory Authority.
You may lodge a complaint with local regulators. For example, if you reside in the European Economic Area (“EEA”), Switzerland or UK, you have a right to lodge a complaint with your local EEA Data Protection Supervisory Authority, the Swiss Federal Data Protection and Information Commissioner, or the UK Information Commissioner’s Office, respectively. If you reside in Australia, you have a right to lodge a complaint with the Office of the Australian Information Commissioner (for further details please see information under the heading “Information for Australia Residents” in Section 12 below). If you reside in the U.S. or Canada, you may have a right to file a complaint to your state, federal or provincial regulator.

If we deny a request, in part or full, you may have a right to appeal that decision.
We will not discriminate against you for exercising these rights, although some of the functionality and features available to you may change or no longer be available to you.

9. How we protect your personal data
The security and confidentiality of your personal data is very important to us. We have implemented reasonable technical and organizational safeguards designed to protect the personal data in our possession. However, no system or method of transmission can be 100% secure. As a result, while we strive to protect your information and privacy, we cannot guarantee or warrant the security of information you disclose or transmit to the Services and cannot be responsible for the accidental, unlawful, the unauthorized access to, inadvertent disclosure of, or use of your personal data. To the extent we provide your personal data to any third parties, we require that they use reasonable security measures to protect your information.
In the event that there is an accidental, unlawful, or unauthorized access to, use of, or inadvertent disclosure of information, we may notify you electronically, in writing, or by telephone, if permitted to do so by law.
10. How long we keep your personal data
We will only retain personal data for as long as necessary to fulfill the purposes for which we have collected such information, including for the purposes of satisfying any legal, accounting or reporting requirements. To determine the appropriate retention periods for all personal data, we consider the amount, nature and sensitivity of the personal data, legal requirements, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the personal data and whether we can achieve those purposes through other means. If we collect “biometric identifiers” or “biometric information,” as those terms are defined by the Illinois Biometric Information Privacy Act (740 ILCS 14), we will delete those biometric identifiers and information when our initial purpose for collecting or obtaining your identifiers or information has been satisfied or within three (3) years of your last interaction with us, whichever occurs first.
11. Minor’s & Children’s data
MLS does not knowingly collect personal data from children under 18 without the consent of a parent or guardian. Under-18s should always ask a parent/guardian for permission to use our digital services. We recommend that parents and guardians clear their browser cache of cookies from time to time to minimize the personal data collected. If we learn that we’ve collected personal data from a child without proper consent, please contact us here and we’ll delete it as soon as possible.
Parents - If you become aware that your child has provided us with personal data without your consent, please reach out to us at privacy@mlssoccer.com so we can take care of it.
12. Cookie and website data
Not just a delicious end-of-game snack, cookies are also small pieces of information stored on your browser when you use our website. We use cookies and website tracking to improve your experience and provide you with relevant content. 13. Automated Decision Making and Profiling
We do not foresee making any substantive decisions about individuals using automated means or profiling in furtherance of decisions that produce legal or similarly significant effects concerning the subject individuals; however, we will notify you in writing if this position changes.
14. Changes to this Privacy Policy
This Privacy Policy replaces any earlier version. You should review this Privacy Policy periodically as we may modify it from time to time. If we change our Privacy Policy in the future, we will post the changed Privacy Policy on the homepage of the Websites and other locations where the policy was previously posted. You will be able to determine what version of the Privacy Policy applies by the “Effective Date” placed under the title. Where consistent with applicable law, your continued use of the Services after we have changed the Privacy Policy signifies your acceptance of the revised terms. Under certain circumstances (e.g., with respect to certain material changes to this Privacy Policy, including the way we use or share personal data previously collected from you through the Services), we may also elect to notify you through additional means, such as posting a notice on the front page of the Websites or by means of an e-mail.
